Cancellation by the Property: a) The property reserves the right to cancel the reservation within 48 hours of confirmation, or due to force majeure, refunding the client 100% of the amounts paid. b) If the cancellation occurs after that period for other reasons (e.g., overbooking), the total amount paid by the client will be refunded plus an additional 10% as compensation.
• The person making the reservation must be of legal age and is responsible for the information provided.
• Subletting or transferring the use of the house to third parties is prohibited.
• The client accepts the condition of the property, furniture, and equipment and will be responsible for any damage or loss caused by them or any occupant during the stay.
• The house must be left clean and without garbage; otherwise, a surcharge will be deducted from the security deposit.
• The use of fireworks, open flames, or flammable or hazardous materials is strictly prohibited.
• Included: water, electricity, internet, heating oil, and alarm system. Telephone use will be charged separately.
• Occasional interruptions by local authorities may occur, for which the owner bears no responsibility.
• The house has one exterior security camera recording the parking area.
• Cleaning service: for stays over 5 nights, an intermediate cleaning with towel change. For stays over 10 nights, an additional cleaning with linen change. Schedule: 10:30–13:00. No service on Sundays.
• Parties, events, loud music, or any activity disturbing neighbors are prohibited.
• Daytime music must not exceed decibel levels permitted by local ordinances and is strictly prohibited between 22:00 and 09:00 h (quiet hours). The installation of professional or semi-professional sound equipment is expressly forbidden.
• If complaints are received from neighbors or authorities, the owner may intervene, cut the music, and immediately terminate the contract. Tenants will be expelled without refund of unused rental days, and the security deposit will be retained.
• Any fines imposed for these reasons will be borne by the tenant.
11. Pets Only accepted with prior authorization and may incur an additional cleaning fee. Unauthorized animals may result in contract cancellation and total loss of the rental amount and deposit.
12. Keys Loss of keys will incur a minimum charge of €150.
13. Construction in the Area. The property is not responsible for any inconvenience caused by public or private construction nearby.
14. Security and Valuables. The client is responsible for their belongings. The property is not liable for losses, theft, or damages. The tenant is directly and exclusively responsible, releasing the property from any liability, for damages that may occur to persons or items due to services and supplies of the rented property.
• All occupants must provide their information for the mandatory registration with the Ministry of the Interior (SES.HOSPEDAJES). Failure to do so will result in denied access to the property without refund.
• The personal data provided by the TENANTS during the contractual relationship will be processed by THE LANDLORD for the purpose of managing the rental agreement and based on said contractual relationship. THE LANDLORD will not disclose the personal data of the TENANTS to third parties, except when required to comply with legal obligations. THE LANDLORD will retain the data for as long as the contractual relationship remains in effect, subsequently keeping it duly blocked for the limitation period of actions in accordance with applicable civil law.
• THE TENANTS have the rights recognized under current data protection regulations to access, rectify, and delete their data, request its portability, object to its processing, request its limitation, and not be subject to automated individual decisions, including profiling. THE TENANTS may exercise these rights by writing to the address of THE LANDLORD indicated at the beginning of this contract or by email to fuentedeibiza@gmail.com, indicating 'DATA PROTECTION' in the subject line and attaching a copy of a valid official identification document. All requested data are required as part of the contract.
Booking Conditions
ACCEPTANCE. Making any reservation implies the absolute and unconditional acceptance of these general conditions.
USER. The person making the booking must be of legal age and is responsible for the accuracy of the data provided.
Subletting or transferring the property to another person, in whole or in part, is strictly prohibited.
OCCUPANTS. The client may only accommodate the maximum number of people specified in the property's description and in the contracted rate. The client must not exceed the occupancy limit established by the competent Health Authority, including those in force regarding public health measures (COVID-19) at the time of rental. The property reserves the right to revoke the reservation at its discretion in case of non-compliance or to deduct from the security deposit any amount claimed by the property for this reason.
In the event that any of the occupants has a disability and requires any adaptation of the villa's facilities, please inform us and we will assess the feasibility.
PAYMENTS. If the tenant fails to make any of the agreed payments, this rental contract will have no effect, and FUENTE FONTALBA, S.L. will automatically be released from the rental commitment acquired in this document, being free to rent the property to another party. In the event that the tenant is already occupying the property, they must vacate it immediately. In such a case, the landlord will retain 100% of the amounts received as a penalty clause for blocking the rental property subject to this contract.
MODIFICATIONS. Any changes to the booking contract or exceptions to these general conditions will only be valid if agreed in writing between the tenant and the property.
If the tenant ends the rental before the agreed departure date, this will not entitle them to a refund of the unused rental amount.
CHECK-IN TIME. The villa will be available on the day of arrival from 5:00 p.m.
CHECK-OUT TIME. The tenant must vacate and return the keys before 10:00 a.m. on the day of departure. Otherwise, a fee of €10,000 will be charged for each additional day the tenant remains in the villa after the agreed departure date, plus any damages or losses caused by this situation.
SECURITY DEPOSIT. This deposit is required to cover any possible damages to the property or extraordinary services not included in the rental price. The amount will be refunded within 48 hours after departure, once the condition of the property has been verified. If damages are found, the refund may take up to 15 days after deducting the cost of repairs. The tenant is responsible for any damage caused by the misconduct of all occupants of the property. The tenant's liability is not limited to the amount of the deposit.
UTILITIES AND INCLUDED SERVICES. The landlord will cover the costs of water, sewage, electricity, heating oil, alarm system, and internet service. The property has two telephone lines, and the cost of their use will be borne by the tenant. Interruptions in water, electricity, or internet supply are not regular occurrences; however, local authorities may occasionally suspend or limit these services for short periods. The property owner is not responsible for any inconvenience caused by temporary service interruptions.
ACCESS. The owner or their designated staff will have access to the villa for visual inspection, maintenance tasks, or in case of malfunction of any facilities or services.
FURNITURE AND EQUIPMENT. The tenant acknowledges being familiar with the property's characteristics, furniture, and equipment, accepts them as such, and is responsible for any damage or loss that occurs during their stay. The tenant must return them in the same condition at the end of this contract. It is strictly forbidden to rearrange the furniture or make any other modifications to the property.
The tenant must not store or handle explosive (fireworks), flammable, or hazardous materials in the villa.
PETS. Only with the express authorization of the owner and prior agreement at the time of booking will pets be allowed on the property. An additional cleaning fee may apply for accommodating a pet indoors or in the garden. The tenant is responsible for any material or personal damage caused by their pet. If the property becomes aware of a pet on the premises without prior agreement, this may result in contract termination and eviction, with loss of the total cost of the reservation and the security deposit.
CLEANING. The tenant must leave the villa free of garbage and waste, tidy, and not excessively dirty. Otherwise, an additional cleaning fee will be deducted from the deposit.
MUSIC, PARTIES, EVENTS, OR NOISE. Disturbing noises that may bother neighbors are not allowed. Music during the day must not exceed the decibel limit established by local ordinances and is prohibited from 11:00 p.m. to 9:00 a.m. Setting up professional or semi-professional sound systems is expressly forbidden. Parties or events are not permitted. If the competent authority imposes a fine for this reason, the tenants will assume payment of the fine. If the neighbors or the authorities notify the landlord of excessive noise, the landlord may enter the villa to stop the music and may immediately terminate the rental contract. In this case, tenants will be expelled from the villa without the right to a refund, and the property will retain the security deposit.
KEYS. In the event of lost keys (failure to return the same number of keys provided upon arrival), a minimum charge of €150 will be deducted for lock replacement and maintenance services.
CONSTRUCTION WORKS. In case private or governmental construction works take place in the surrounding area, Fuente Fontalba, S.L. has no control over such works and is not responsible for any disturbance they may cause.
TENANT'S LIABILITY. The tenant is directly and exclusively responsible - and releases the property from all liability - for any damages to persons or property caused by the services and supplies of the rented property.
Valuable items left in the property are under the tenants' own responsibility. The landlord will not be held liable for their loss, theft, or breakage.
The tenant must ensure that all doors and windows are closed and the alarm is activated before leaving the villa.
DATA PROTECTION. All data requested are collected as part of the contractual process.
ELECTRONIC CONTRACTING. The contract is carried out exclusively through the email correspondence exchanged between the parties.
PROMOTIONAL COMMUNICATION AUTHORIZATION. The client authorizes FUENTE FONTALBA, S.L. to send promotional communications by email, provided that they can unsubscribe at any time.
LAW AND JURISDICTION. This contract is governed by Spanish law. For all matters related to this contract, both parties submit to the jurisdiction of the Courts of Ibiza.
