Cancellation Policy:

If the client cancels the reservation, no amount will be refunded. In the event that the client informs the property, prior to the check-in date, of the impossibility of occupying the property and both parties agree to offer it for rent again, there would be the possibility of a full refund if an alternative reservation is made for those dates with the same price or a partial refund if the owner needs to make an alternative reservation at a lower rate (pro rata). If the owner cannot successfully re-rent the property, the owner will keep the total payment. If the client does not show up on the day of check-in (NO SHOW), the owner will keep 100% of the amounts received as a penalty clause for immobilization of the leased property.

The owner may cancel within 48 hours after the confirmation of the reservation, refunding 100% of the amounts paid by the client. For the rest of the situations in which the owner wishes to cancel, the amount paid by the client will be refunded plus a 10% indemnity.

COVID-19 Cancellation: If at the time of check-in there is impossibility to travel as a result of insurmountable restrictions between the tenant's country of origin and the island of Ibiza, the owner will refund the total amounts paid as we are in a case of cancellation due to force majeure, freely disposing of the property.

Booking Conditions:

ACCEPTANCE: The making of any reservation implies the absolute and unconditional acceptance of these general conditions.

USER: The person making the reservation must be of legal age and is responsible for the veracity of the data entered.

Subleasing or assigning the property to another person, in whole or in part, is prohibited.

OCCUPANTS: The client can only accommodate the maximum number of people defined in the characteristics of the property and the contracted rate. The client will not exceed the capacity established by the competent Authority for public health reasons, COVID19, in force at the time of the lease. The property reserves the right to revoke the reservation at its discretion in the event of non-compliance or to deduct from the security deposit the amount that the property could claim for this concept.

In case any of the occupants have a disability and need to adapt any installation of the villa, please let us know and we will look into its viability.

PAYMENTS: If the tenant does not make any of the agreed payments, this lease contract will have no effect and FUENTE FONTALBA, S.L. will be automatically released from the lease commitment acquired in this document, being able to freely dispose of the property and in the event that the tenant lives in it, must make it available to the lessor immediately. In this case, the lessor will keep 100% of the amounts received as a penalty clause for immobilization of the leased property subject to this contract.

MODIFICATIONS: Modifications to the reservation contract and exceptions to these general booking conditions will only be effective with a written agreement between the tenant and the property.

In the event that the tenant terminates the lease before the agreed term, this fact will not entitle him to a refund of the rental price not enjoyed.

CHECK-IN TIME: The villa will be available on the day of arrival from 5:00 p.m.

CHECK-OUT TIME: The tenant must vacate and return the keys before 10:00 a.m. on the day of departure. Otherwise, he must pay €10,000 for each day he stays in the villa after the established departure date, plus all damages and losses that this situation may entail.

SECURITY DEPOSIT: A security deposit of €5,000 is required to cover the cost of possible damages to the property or extraordinary services not included in the rental price. This amount will be refunded 48 hours after departure, once the condition of the property has been checked or, in the event of damages, the refund may be made within 15 days after deducting the amount of the damages caused. The tenant will be responsible for damages caused by the misconduct of all occupants of the property. The tenant's liability is not limited to the amount of the deposit.

EXPENSES AND INCLUDED SERVICES: Water, sanitation, electricity, diesel, alarm, and internet service supplies will be borne by the lessor. The property has two telephone lines and the cost of using it will be borne by the tenant. Cuts in water, electricity, or internet supply are not regular. However, local authorities may occasionally cut or limit supplies for short periods of time. The property owner is not responsible for the inconvenience caused by temporary supply cuts.

ACCESS: The owner or personnel designated by him will have access to the villa for visual inspection that everything is correct or, to perform whatever maintenance tasks may be necessary, as well as in case of breakdown in any of the facilities or services.

FURNITURE AND EQUIPMENT: The tenant declares to know the characteristics and conservation status of the property, furniture, and equipment, expressly accepting them, and is responsible for the damages or losses that occur in the property or its contents during their stay as well as for the return of the same at the end of this contract. It is strictly forbidden to change the position of the furniture in the property or make any other modification. The tenant will not have or handle explosive (fireworks), flammable, or unhealthy materials in the property.

PETS: Only with the express authorization of the owner and prior agreement at the time of booking, the stay of a pet in the property will be allowed. There may be an additional charge for final cleaning for hosting a pet indoors or in the garden. The tenant is responsible for any material or personal damage caused by their pet. If the property becomes aware that there is a pet in the villa without prior agreement, this could result in the cancellation of the contract and the eviction of the property, with the loss of the total cost of the reservation and the security deposit.

CLEANING: The tenant must deliver the villa free of garbage and waste, as well as collected and not excessively dirty, otherwise, a surcharge will be applied to be deducted from the deposit.

MUSIC, PARTIES, EVENTS, OR NOISE: It is not allowed to make annoying noises to the neighbors. Music during the day must not exceed the decibels allowed according to municipal regulations and will be prohibited from 11:00 p.m. until 9:00 a.m., expressly forbidding the assembly of professional or semi-professional music equipment. The celebration of parties or events is not allowed. In the event that the competent Authority imposes a fine for this fact, the tenants will assume the payment of the amount thereof. In the event that neighbors or the competent Authority notify the lessor of an excess of noise, he may enter the villa and turn off the music, and may immediately terminate the lease agreement, with the tenants being expelled from the villa without the right to a refund of the rental price not enjoyed and the property keeping the security deposit.

KEYS: In case of loss of keys (failure to deliver the same number of keys as were delivered upon arrival), a minimum of €150 will be deducted for changing the lock and maintenance services.

Construction: If private or governmental construction works are carried out in the vicinity, Fuente Fontalba, S.L. would have no influence on those works and is not responsible for any disturbance they may cause.

TENANT'S LIABILITY: The tenant is directly and exclusively responsible, and exempts the property from any liability, for damages that may be caused to persons or things by services and supplies of the leased property.

Valuables that tenants may deposit in the property will be under their own responsibility, and the lessor will not be responsible for their loss, theft, or breakage.

The tenant will ensure that all doors and windows are closed and the alarm is activated before leaving the villa.

DATA PROTECTION: All data requested are part of the contract.

ELECTRONIC CONTRACTING: The contract is made exclusively through the emails sent between the parties.

AUTHORIZATION OF PROMOTIONAL COMMUNICATIONS: The client authorizes FUENTE FONTALBA, SL. to send promotional communications by email provided that they can unsubscribe at any time.

LAW AND COURT: This contract is subject to Spanish Law. For all matters related to this contract, both parties submit to the jurisdiction of the Courts of Ibiza.
