ACCEPTANCE. Making any reservation implies absolute and unconditional acceptance of these general conditions.
USER. The person making the reservation must be of legal age and is responsible for the accuracy of the data entered.
Subleasing or transferring the property to another person, wholly or partially, is prohibited.
OCCUPANTS. The client can only accommodate the maximum number of people defined in the property's characteristics and the contracted rate. The client will not exceed the capacity established by the competent authority for public health reasons, including COVID-19, in force at the time of rental. The property reserves the right to revoke the reservation at its discretion in the event of non-compliance or deduct from the security deposit the amount the property may claim for this concept.
If any of the occupants have a disability and require any adaptations to the villa's facilities, please let us know and we will assess its feasibility.
PAYMENTS. If the tenant fails to make any agreed payments, this rental contract will have no effect, and FUENTE FONTALBA, S.L., will be automatically released from the rental commitment acquired in this document, and may freely dispose of the property. If the tenant is already living in the property, they must vacate it immediately. In this case, the landlord will retain 100% of the amounts received as a penalty clause for immobilizing the rented property.
MODIFICATIONS. Modifications to the reservation contract and exceptions to these general reservation conditions will only take effect with a written agreement between the tenant and the property.
If the tenant ends the rental before the scheduled term, this will not entitle them to a refund of the unused rental price.
CHECK-IN TIME. The villa will be available on the day of arrival from 5 PM.
CHECK-OUT TIME. The tenant must vacate and return the keys before 10 AM on the day of departure. Otherwise, they must pay €10,000 for each day they remain in the villa after the established departure date, plus all damages and losses incurred.
SECURITY DEPOSIT. A security deposit of €5,000 is required to cover the cost of any damages to the property or extraordinary services not included in the rental price. This amount will be refunded 48 hours after departure, once the condition of the property has been checked, or if there are damages, the refund can be made within 15 days after deducting the amount of the damages. The tenant will be responsible for damages caused by the misconduct of all occupants of the property. The tenant's responsibility is not limited to the amount of the deposit.
EXPENSES AND SERVICES INCLUDED. The landlord will cover the costs of water, sanitation, electricity, diesel, alarm, and internet service. The property has two telephone lines, and the cost of their use will be borne by the tenant. Interruptions in water, electricity, or internet supply are not regular. However, local authorities may occasionally cut or limit supplies for short periods. The property owner is not responsible for inconveniences caused by temporary supply interruptions.
ACCESS. The owner or their designated personnel will have access to the villa for inspection to ensure everything is correct or to carry out necessary maintenance tasks, as well as in the event of a breakdown in any of the facilities or services.
FURNITURE AND EQUIPMENT. The tenant declares to know the characteristics and condition of the property, furniture, and equipment, expressly accepting them, and is responsible for damages or losses occurring in the property or its contents during their stay, as well as their return at the end of this contract. It is strictly forbidden to change the position of the furniture in the property or make any other modifications.
The tenant will not possess or handle explosive (fireworks), flammable, or unhealthy materials in the property.
PETS. Only with the express authorization of the owner and prior agreement at the time of reservation will pets be allowed in the property. There may be an additional final cleaning charge for hosting a pet inside or in the garden. The tenant is responsible for any material or personal damage caused by their pet. If the property becomes aware of a pet in the villa without prior agreement, this could result in contract cancellation and eviction from the property, with the loss of the total reservation cost and the security deposit.
CLEANING. The tenant must leave the villa free of garbage and waste, tidy, and not excessively dirty; otherwise, an additional charge will be applied and deducted from the deposit.
MUSIC, PARTIES, EVENTS, OR NOISE. No disturbing noises are allowed to the neighbors. Music during the day must not exceed the decibel levels allowed by municipal ordinances and is prohibited from 11 PM to 9 AM. The installation of professional or semi-professional music equipment is expressly prohibited. Parties or events are not allowed. If the competent authority imposes a fine for this fact, the tenants will assume the payment. If neighbors or the competent authority notify the landlord of excessive noise, the landlord may enter the villa and turn off the music and may immediately terminate the rental contract, with the tenants being expelled from the villa without the right to a refund of the unused rental price, and the property retaining the security deposit.
KEYS. In case of loss of keys (failure to return the same number of keys provided upon arrival), a minimum of €150 will be deducted for changing the lock and maintenance services.
WORKS. If private or governmental construction works are carried out in the surroundings, Fuente Fontalba, S.L. would have no influence over those works and is not responsible for any disturbances they may cause.
TENANT'S RESPONSIBILITY. The tenant is directly and exclusively responsible, and exempts the property from all liability, for damages that may be caused to people or things by the services and supplies of the rented property.
Valuable items that tenants may deposit in the property are at the tenant's own risk, and the landlord is not responsible for their loss, theft, or breakage.
The tenant will ensure that all doors and windows are closed, and the alarm is connected before leaving the villa.
DATA PROTECTION. All requested data are part of the contract.
ELECTRONIC CONTRACTING. The contract is carried out exclusively through emails exchanged between the parties.
AUTHORIZATION OF PROMOTIONAL COMMUNICATIONS. The client authorizes FUENTE FONTALBA, S.L. to send promotional communications by email, with the option to unsubscribe at any time.
LAW AND COURT. This contract is subject to Spanish law. For all matters related to this contract, both parties submit to the jurisdiction of the Courts of Ibiza
